Enlarging Scope of \u201cOnline Transaction Operators\u201d\u00a0<\/strong>1<\/a><\/sup><\/p>\n The Measures provides that\u00a0online social networking<\/strong><\/em>\u00a0and\u00a0online livestreaming<\/strong><\/em>providers who offer online business sites and services such as commodity browsing, order generation, online payment and so forth are within the scope of online transaction platform operators.2<\/a><\/sup><\/p>\n This enlargement captures the increase of livestreaming shopping users in China which account for more than a third of internet users in China.<\/p>\n 2. Clarifying Transactions Exempted from Registration<\/strong>3<\/a><\/sup><\/p>\n According to E-commerce Law, it is mandatorily requested for e-commerce operators to register at local administrations for market regulation (the \u201cAMRs\u201d), i.e. obtaining a business license. Nevertheless, \u201coccasional small-sum transactions\u201d or \u201cconvenient labor activities\u201d4<\/a><\/sup>\u00a0can be exempted under the following specific circumstances, specified in the Measures:<\/p>\n (1) Individuals who engage in online transaction with total annual turnover that does not exceed 100,000 RMB; and<\/p>\n (2) Individuals who engage in activities such as cleaning, washing, sewing, hairdressing, moving, key preparation, pipeline dredging, home appliance and furniture repair via Internet.<\/p>\n 3. Defining More False Advertising Activities<\/strong>5<\/a><\/sup><\/p>\n The Measures adds several false advertising activities:<\/p>\n (1) misleadingly displaying user comments, e.g., putting the positive comments up front, the negative comments behind, or not prominently distinguishing comments from different goods and services;<\/p>\n (2) falsely claiming the spot goods, fictitious reservation, fictitious preemption, etc;<\/p>\n (3) making up traffic data such as hits and attention, and making up transaction interaction data such as favorite and reward.<\/p>\n 4.
