It is indeed what is provided by the fine prints of the PRC Civil Procedural Law as well as the practice in the developed coastal areas. But that is not the case for other parts of the large country, where the judicial system internally designated a few courts to deal with foreign related matters. For example, in a central China province with 18 intermediary courts, only 3 can deal with foreign related matters.[\/vc_column_text][\/vc_column][\/vc_row][vc_row row_type=&#8221;row&#8221; use_row_as_full_screen_section=&#8221;no&#8221; type=&#8221;full_width&#8221; angled_section=&#8221;no&#8221; text_align=&#8221;left&#8221; background_image_as_pattern=&#8221;without_pattern&#8221; padding_top=&#8221;50&#8243; padding_bottom=&#8221;15&#8243; css_animation=&#8221;&#8221;][vc_column][vc_single_image image=&#8221;17392&#8243; img_size=&#8221;65&#215;65&#8243; qode_css_animation=&#8221;&#8221;][\/vc_column][\/vc_row][vc_row row_type=&#8221;row&#8221; use_row_as_full_screen_section=&#8221;no&#8221; type=&#8221;full_width&#8221; angled_section=&#8221;no&#8221; text_align=&#8221;left&#8221; background_image_as_pattern=&#8221;without_pattern&#8221; padding_bottom=&#8221;50&#8243; css_animation=&#8221;&#8221;][vc_column][vc_column_text]<span style=\"color: #000000;\"><strong>Mistake 2: Get translation from a \u201cGood\u201d translator.<\/strong><\/span><\/p>\n<p>As most &#8220;to-go&#8221; Chinese lawyers for foreigners are based in modern cities like Shanghai and Beijing, they usually work with nearby translators. However, in practice, it is an undocumented practice that each court has its own designated translator in its own city that are only disclosed upon checking with the court.[\/vc_column_text][\/vc_column][\/vc_row][vc_row row_type=&#8221;row&#8221; use_row_as_full_screen_section=&#8221;no&#8221; type=&#8221;full_width&#8221; angled_section=&#8221;no&#8221; text_align=&#8221;left&#8221; background_image_as_pattern=&#8221;without_pattern&#8221; background_color=&#8221;#ffffff&#8221; padding_top=&#8221;50&#8243; padding_bottom=&#8221;15&#8243; css_animation=&#8221;&#8221;][vc_column][vc_single_image image=&#8221;17393&#8243; img_size=&#8221;65&#215;65&#8243; qode_css_animation=&#8221;&#8221;][\/vc_column][\/vc_row][vc_row row_type=&#8221;row&#8221; use_row_as_full_screen_section=&#8221;no&#8221; type=&#8221;full_width&#8221; angled_section=&#8221;no&#8221; text_align=&#8221;left&#8221; background_image_as_pattern=&#8221;without_pattern&#8221; background_color=&#8221;#ffffff&#8221; padding_bottom=&#8221;50&#8243; css_animation=&#8221;&#8221;][vc_column][vc_column_text]<span style=\"color: #000000;\"><strong>Mistake 3: \u201cDuly authenticated original award or a duly certified copy thereof\u201dproduced in the \u201cplace of arbitration\u201d<\/strong><\/span><\/p>\n<p>When it comes to the nationality of the award, even the PRC Supreme People\u2019s Court has been swinging between the \u201cseat of the arbitration institution\u201d and the \u201cplace of arbitration\u201d, since the Chinese judicial system considers arbitral awards being rendered by the institution. Although it has been improving, there are a still lot of confusions in the minds of judges at the lower courts. If legalized in the \u201cwrong\u201d Chinese Embassy, the applicant has to re-legalize the documents[\/vc_column_text][\/vc_column][\/vc_row][vc_row row_type=&#8221;row&#8221; use_row_as_full_screen_section=&#8221;no&#8221; type=&#8221;full_width&#8221; angled_section=&#8221;no&#8221; text_align=&#8221;left&#8221; background_image_as_pattern=&#8221;without_pattern&#8221; padding_top=&#8221;50&#8243; padding_bottom=&#8221;15&#8243; css_animation=&#8221;&#8221;][vc_column][vc_single_image image=&#8221;17394&#8243; img_size=&#8221;65&#215;65&#8243; qode_css_animation=&#8221;&#8221;][\/vc_column][\/vc_row][vc_row row_type=&#8221;row&#8221; use_row_as_full_screen_section=&#8221;no&#8221; type=&#8221;full_width&#8221; angled_section=&#8221;no&#8221; text_align=&#8221;left&#8221; background_image_as_pattern=&#8221;without_pattern&#8221; padding_bottom=&#8221;50&#8243; css_animation=&#8221;&#8221;][vc_column][vc_column_text]<span style=\"color: #000000;\"><strong>Mistake 4: \u201cThere is no corruption\u201d or \u201cthere are too many corruptions\u201d or \u201cGuangxi is decisive\u201d<\/strong><\/span><\/p>\n<p>Corruption might not be uncommon China, but severely fought due to recent campaign of the Chinese authorities. Like anywhere else in the world, \u201cGuanxi\u201d (connections) may play an important role in everything. As the traditionally faced serious difficulties in enforcing judicial decisions, there have been the \u201cdifficult enforcement\u201d (\u6267\u884c\u96be). According to the SPC Report on Enforcement Work (2016), in 40% &#8211; 50% of the cases there are no property for enforcement, which means in those cases the enforcement proceedings do not allow a realization of the decisions in the award. Another obstacle is made of the huge caseload that PRC courts must handle.
