Anti-Monopoly Law: New Revisions to Anti-Monopoly Law<\/h3>\n<p>[\/vc_column_text][vc_column_text]<\/p>\n<div>\n<div>\n<p>The Decision of the Standing Committee of the National People&#8217;s Congress on Amending the Anti-Monopoly Law of the People&#8217;s Republic of China was adopted on June 24, 2022, which shall come into force on August 1, 2022 (the \u201cAmendment\u201d). This is the first amendment of current applicable Anti-Monopoly Law since its implementation in 2008, which will address new issues encountered these years to help boost fair competition in the market and further improve China\u2019s anti-monopoly rules and enforcement.<\/p>\n<p>The principal revisions are as follows:<\/p>\n<p><strong>(1) Rules related to enforcement authority<\/strong><\/p>\n<p>The anti-monopoly enforcement authority has been changing over the years. At the beginning of the implementation of the current applicable Anti-Monopoly Law,<sup>1<\/sup> the enforcement authorities were the National Development and Reform Commission, the State Administration for Industry and Commerce and the Ministry of Commerce. It changed into the State Administration for Market Supervision in 2018 and then there were proposals of establishing a National Anti-Monopoly Bureau in 2021.<\/p>\n<p>According to the Amendment, it was changed to the \u201c<strong>anti-monopoly enforcement authority of the State Council<\/strong>\u201d,<sup>2<\/sup> leaving room for possible future institutional adjustments.<\/p>\n<p><strong>(2) Rules related to digital platform<\/strong><\/p>\n<p>To ensure the healthy development of digital platform industry, the Amendment clarifies that business operators must not exploit any <strong>data<\/strong> or<strong> algorithms<\/strong>, <strong>technology<\/strong>, <strong>capital advantages <\/strong>or <strong>platform rules<\/strong> to engage in any monopolistic conduct prohibited by this Law.<sup>3<\/sup><\/p>\n<p><strong>(3) Rules related to Resale Price Maintenance<\/strong><\/p>\n<p>Resale Price Maintenance refers to a price restriction demanded by an upstream company to retain control of the price of its products to the downstream company selling its products.<\/p>\n<p>The following resale price maintenance agreements are prohibited in China:<\/p>\n<ol>\n<li>Agreement restricting the minimum price for resale to a third party<\/li>\n<li>Agreement fixing the price for resale to a third party<\/li>\n<\/ol>\n<p>The Amendment newly adds that resale price maintenance agreements will not be prohibited if:<sup>4<\/sup><\/p>\n<ol>\n<li>the business operator can prove that it does not have the <strong>effect of excluding or limiting competition<\/strong><sup>5<\/sup> or<\/li>\n<li>the business operator can prove that their <strong>market share<\/strong> in the relevant market is <strong>lower<\/strong> than the threshold set by the enforcement authority<sup>6<\/sup><\/li>\n<\/ol>\n<p>Further clarification and detailed legislation will be released to clarify the implementation of the Amendment.<\/p>\n<p>Should you need any details about the amended Anti-Monopoly Law, please kindly reach <a href=\"mailto:asialians@asiallians.com\">asialians@asiallians.com<\/a>.<\/p>\n<p><a href=\"https:\/\/kevinwoodesigns.createsend1.com\/t\/d-l-fddukit-l-y\/\">http:\/\/www.npc.gov.cn\/npc\/kgfb\/202206\/24e425d6ac624742a4460ec90dae0d9a.shtml<\/a><\/p>\n<\/div>\n<\/div>\n<div><\/div>\n<p>[\/vc_column_text][vc_separator type=&#8221;transparent&#8221; thickness=&#8221;50&#8243;][\/vc_column][\/vc_row][vc_row css_animation=&#8221;&#8221; row_type=&#8221;row&#8221; use_row_as_full_screen_section=&#8221;no&#8221; type=&#8221;full_width&#8221; angled_section=&#8221;no&#8221; text_align=&#8221;left&#8221; background_image_as_pattern=&#8221;without_pattern&#8221;][vc_column][vc_column_text]<\/p>\n<h3 class=\"size-24\" lang=\"x-size-24\">2. Covid-19 Update: New Visa Policy to Enter China<\/h3>\n<p>[\/vc_column_text][vc_column_text]Under the current visa policy, for travelers to enter China, an invitation letter<sup>7<\/sup>approved by Chinese government shall be obtained first. Upon receipt of such invitation letter, travelers can further apply for several types of Visas.
